The performing rights problem (or: YouTube v GEMA)

A street musician - ©iStockphoto.com/dmitrievadmitrievaA court case in Germany made the international headlines last week.  Billed in some cases as “YouTube v GEMA” it dealt with the issue of whether Google has to pay royalties for the music that people upload to the YouTube service.

Since GEMA is not that well known outside of Germany, it’s probably fair to compare them with the PRS in the UK or ASCAP in the USA.  Their job is to collect royalties from anyone using the music written or composed by their members.

This is a very important point: they represent the songwriters and composers, not necessarily the artists.

Just for a moment, think about what it means if you just use a piece of music on your YouTube video, without getting permission to first.  You are probably infringing on the copyright of the record label or the performer on one level, but on another you are using words and music written by someone as well. Chris Malu sang the Hessentag song

On Tuesday afternoon (14th June) it was local singer Chris Malu’s turn to entertain the wine village in the Rushmoor Park at the Hessentag in Oberursel.

Starting with the Hessentag song “Oberursel, Tor zum Taunus”, the much of her repertoire concentrated on the subject of “wine”, with songs such as “Weinparadies”, “Einmal am Rhein” and her own composition “Champagnelaune”.

But she also sang classic Schlager songs such as “Ein Stern, der Deinen Namen trägt”. [Read more…]

The Nachhaltigkeitssong Premiere with Jennifer Braun

The premiere of the new “Nachhaltigskeitssong” took place at the Hessentag in Oberursel on Sunday.

Nachhaltigkeit means sustainability, and is one of the keywords at the Hessentag.  The pop song, called “Jetzt und für immer” (now and for ever) was performed by Jennifer Braun and the band “Rewind” on the Süwag stage in the Rushmoor Park.

The song project was introduced by local radio presenter Bastian Korff with the finance minister for the State of Hesse, Prof. Dr. Luise Hölscher, and CO2 learning network representative Jörg Schmidt. [Read more…]
